The technical legal term for buying and Selling of property is conveyancing which means the legal transfer of title from the seller to the buyer in exchange for payment. If handled well, conveyancing should be routine and trouble free but there are many issues and potential pitfalls and conveyancing transactions which do go wrong can go very wrong. That is why you should never sign any agreement or documents without checking with your solicitor first.

  • Is the property being sold described correctly?
  • Is the price correct and are there any GST issues?
  • What type of title is it and what encumbrances is it subject to?
  • Is the agreement (or should it be) conditional upon certain issues being checked out?

  • How is the purchaser to take title (eg. jointly or as tenants in common or as a company or family trust)?
  • Is finance documentation correct and/or does it contain hidden "hooks"?
  • How and when is possession or settlement to take place?
